1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of mintora-artworks.com (the "Site"), our digital design services, and all related services (collectively, the "Services") provided by Mintora Artworks LLC ("Mintora", "we", "us", or "our"). Located at 6 S Tejon St, Colorado Springs, CO 80903, United States.

By purchasing services, accessing the Site, or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

2. Description of Services

We provide premium digital design services including:

• Brand Identity Design ($2,999) - Complete corporate branding systems
• UI/UX Design ($3,999) - Web/app interface design with testing
• Marketing Materials Design ($2,499) - Pitch decks, campaigns, templates
• Digital Product Design ($5,999) - SaaS platforms and design systems

All services delivered as editable source files (Figma, Adobe Illustrator, etc.) with full commercial rights.

3. Orders and Payment

3.1 Order Process

• Orders processed via Shopify checkout
• Immediate digital access to project briefing form upon purchase
• Project timeline begins upon receipt of completed brief (48 hours to confirm)
• All payments final - no cancellations after brief submission

3.2 Payment Terms

• Full payment required upfront via Shopify Payments
• Accepted: Credit cards, Apple Pay, Google Pay, PayPal
• Prices in USD, exclusive of applicable taxes
• No refunds (see Section 12)

3.3 Taxes

You are responsible for all sales, use, VAT, GST, and other taxes unless prepaid through Shopify checkout.

• Secure file delivery via Google Drive / Dropbox links
• All source files: Figma, AI, SVG, PDF, PNG @3x
• 3-year perfection warranty included

5. Revisions Policy

• Round 1: 3 concept directions (choose 1)
• Round 2: 2 major revisions on selected concept
• Round 3+: Unlimited refinements until strategic satisfaction
• Revisions must be requested within 7 days of delivery
• Scope changes require change order + additional fees

6. Intellectual Property

6.1 License Grant

Upon full payment, you receive:

• Full commercial rights to all final deliverables
• 100% ownership transfer of custom artwork
• All source files (Figma, Adobe, etc.)
• Perpetual license - no attribution required

6.2 Our Rights

• Portfolio display rights (removable upon request)
• License to use your project brief as case study inspiration
• Ownership of our design process, concepts, and tools

6.3 Third-Party Assets

Stock photos/fonts disclosed upfront. Fonts licensed appropriately for commercial use.

7. Client Responsibilities

• Provide complete, accurate project brief within 48 hours
• Respond to revision requests within 72 hours
• Supply necessary assets (logos, content, brand guidelines)
• Ensure project requirements don't infringe third-party rights
• Not use deliverables in violation of applicable laws

8. Cancellation & Termination

8.1 Before Brief Submission

Full refund minus 5% processing fee within 24 hours of purchase.

8.2 After Brief Submission

• No refunds - project enters production queue
• Partial deliverables provided pro-rata
• License converts to non-commercial only

9. Warranty & Liability

9.1 Our Warranty

• Files functional across modern browsers/devices
• 3-year perfection warranty - free updates for business evolution
• Professional standard of care in design execution

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability shall not exceed service fees paid
• No consequential, indirect, or punitive damages
• No liability for your business losses or lost profits
• Services provided "AS IS" without other warranties

10. Force Majeure

We are not liable for delays due to acts of God, war, pandemics, natural disasters, or other events beyond our reasonable control.

11. Governing Law

These Terms governed by Colorado, USA law. Disputes resolved exclusively in El Paso County, Colorado courts. You consent to this jurisdiction and venue.
